Governing Law

The Food Safety and Standards Authority of India (FSSAI) is the legal authority responsible for issuing food licenses to all Food Business Operators (FBOs) in India.

Under Section 31(1) of the Food Safety and Standards Act, 2006, every Food Business Operator in the country must be licensed by the Food Safety & Standards Authority of India (FSSAI). The FSSAI licensing and registration procedure, as well as requirements, are governed by the Food Safety & Standards (Licensing and Registration of Food Business) Regulations, 2011.

FSSAI registration is based on the business types, turnover and capacity of production. Depending upon the installed capacity and turnover, FBOs are eligible for license such as basic license, central license, and state license.

  • FSSAI Basic Registration– FBOs having a turnover of less than Rs.12 lakh p.a must obtain FSSAI basic registration. The FSSAI registration form that the applicant has to fill to obtain FSSAI basic registration is Form A.
  • FSSAI State License– FBOs having a turnover of more than Rs.12 lakh p.a and less than Rs.20 crore p.a must obtain the FSSAI state license. The FSSAI registration form that the applicant has to fill to obtain an FSSAI state license is Form B.
  • FSSAI Central License– FBOs having a turnover of more than Rs.20 crore p.a must obtain the FSSAI central license. The FSSAI registration form that the applicant has to fill to obtain FSSAI central license is Form B.

  • Food Business Operators (FBOs) can obtain FSSAI registration online by filling and submitting Form A (Application for Registration) or Form B (Application for State and Central License) on the FoSCoS portal. Alternatively, FBOs can register offline by submitting these forms to the Food and Safety Department.
  • The FSSAI registration form must be accompanied by the required documents. These documents can be uploaded online on the FoSCoS portal during the application process or submitted physically to the Food and Safety Department along with the application.
  • The FSSAI registration form will be either accepted or rejected by the Department within 7 days of receiving the application, whether submitted physically or online. If the application is rejected, the applicant will be notified in writing.
  • The Department will scrutinize the submitted documents and may conduct an inspection of the food premises before granting the FSSAI registration certificate if necessary. If the Department is satisfied that the FBO meets all required criteria, it will grant an FSSAI registration certificate with a registration number and the applicant’s photo.
  • The applicant can download the FSSAI registration certificate by logging into the FoSCoS portal. FBOs should prominently display the FSSAI registration certificate at their place of business during operating hours.

FSSAI Registration Eligibility

FSSAI Registration is a basic license required for all Food Business Operators (FBOs) involved in small-scale food businesses. This category includes the following businesses:

  • Any FBO with an annual turnover of not more than Rs. 12 lakh.
  • Petty retailers dealing in food products.
  • Individuals who manufacture or sell any food articles by themselves.
  • Temporary stall holders selling food.
  • Individuals distributing food at religious or social gatherings, excluding caterers.
  • Small-scale or cottage industries in the food business.

Specific capacity limits for small businesses are as follows:

For all Food Business Operators (FBOs) apart from small-scale businesses, an FSSAI license is required. The FSSAI license is classified into two categories: State FSSAI License and Central FSSAI License, based on the business size—whether medium-scale or large-scale.

State FSSAI License

FBOs with medium-sized manufacturing units, transporters, marketers, traders, etc., need to obtain State FSSAI registration from the State Government. This category covers the following businesses:

  • FBOs with an annual turnover between Rs. 12 lakh to Rs. 20 crore (Rs. 30 crore for transportation businesses and wholesalers).
  • All grains, cereals, and pulses milling units, regardless of production capacity.

Medium-scale businesses with the following capacity limits:

These criteria ensure that medium-scale food businesses operate under the appropriate FSSAI license.

The tenure of the license issued is a maximum of 5 years and a minimum of 1 year.

 

Central FSSAI License

FBOs who are large manufacturers, importers, and exporters dealing in large-scale food businesses need to obtain Central FSSAI registration from the Central Government. This category covers the following businesses:

  • FBOs with an annual turnover above Rs. 20 crore (Rs. 30 crore for transportation businesses and wholesalers).
  • The following FBOs, irrespective of turnover or size of business:
    • Food businesses operating in two or more states
    • Importers and exporters
    • Proprietary food and non-specified food
    • Food or health supplements and nutraceuticals
    • Radiation processing of foods
    • Food business activities at premises of Central Government agencies
    • Caterers, restaurants, canteens, hawkers, or petty retailers at railway stations
    • E-commerce food businesses

Large-scale businesses with the following capacity limits:

These criteria ensure that large-scale food businesses operate under the appropriate Central FSSAI license.

To obtain FSSAI basic registration, state license, or central license, the following documents are required:

  • General Documents:
    • Photo identity proof of the food business operators.
    • Business constitution certificate (e.g., partnership deed, certificate of incorporation, shop and establishment license, or other business registration certificate).
    • Proof of possession of business premises (e.g., rental agreement, NOC from the owner, utility bills).
    • Food safety management system plan.
    • List of food products manufactured or processed.
    • Bank account information.
    • Supporting documents (if required), such as NOC from Municipality or Panchayat, Health NOC, copy of license from the manufacturer, etc.
  • Specific Documents for FSSAI State License:
    • Form B, duly completed and signed.
    • Plan of the processing unit showing dimensions and operation-wise area allocation.
    • List of Directors/Partners/Proprietor with address, contact details, and photo ID.
    • Name and list of equipment and machinery used, with the number and installed capacity.
    • Authority letter from the manufacturer nominating a responsible person with name and address.
    • Analysis report of water to be used in the process to confirm its potability.
    • Copy of certificate obtained under the Coop Act 1861/Multi-State Coop Act 2002.
  • Specific Documents for FSSAI Central License:
    • Form B, duly completed and signed.
    • Plan of the processing unit showing dimensions and operation-wise area allocation.
    • List of Directors/Partners/Proprietor with address, contact details, and photo ID.
    • Name and list of equipment and machinery used, with the number and installed capacity.
    • Authority letter from the manufacturer nominating a responsible person with name and address.

    • Source of raw material for milk, meat, etc.
    • Recall plan, wherever applicable.
    • Ministry of Commerce Certificate for 100% Export Oriented Units (EOU).
    • NOC/PA document issued by FSSAI.
    • Import Export Code (IE code) document issued by DGFT.

    • Certificate from the Ministry of Tourism.
    • Supporting document for proof of turnover and transportation.
    • Declaration form.

Applicants/FBOs are required to pay a fee when submitting the FSSAI registration form. The fees for different types of FSSAI registration are as follows:

  • FSSAI Basic Registration: Rs. 100
  • FSSAI State License: Rs. 2,000 to Rs. 5,000 (depending on the type of business)
  • FSSAI Central License: Rs. 7,500

Renewing the FSSAI license is essential to continue operating a food business. The license is issued for a validity period ranging from 1 to 5 years. Businesses must apply for renewal at least 30 days before the current license expires.
