A design is defined under Section 2(d) of the Designs Act 2001, as only the features of a shape, pattern, configuration, composition, or ornament of lines or colors that are applied to any article that is two dimensional, three dimensional, or both by an industrial process or any means whether mechanical, manual or chemical, separated or combined, which in the finished article are judged solely by the eye; but is not taken into account upon the principle of construction or anything which is in substance a merely mechanical device.

- If a product’s design has a novelty aspect, it becomes eligible for registration.
- No Prior Publication:

- Prior publication can jeopardize the uniqueness required for design registration.
- Application to an Article:
- The design should be applied to an article. In other words, it should be integrated into a tangible product.
- Abstract designs without practical application are not eligible for registration.
- Public Order, Morality, and Security:
- The design should not be contrary to public order, morality, or the security of India.
- Offensive or scandalous designs may be rejected during the registration process.
- Documents Required:
- When applying for design registration, you’ll need the following documents:
- Representation of the design: This can be drawings, photographs, or other visual representations.
- Statement of novelty: Clearly describe the unique features of your design.
- Disclaimer: If any part of the design is common or not claimed, include a disclaimer.
- Claim a priority date: If applicable, claim priority based on an earlier application.
- When applying for design registration, you’ll need the following documents:
Payment of fees: Pay the prescribed fees for filing and processing the application.
The following categories of individuals can apply for design registration:
- Applicants: Individuals, their legal representatives, or assignees can apply either individually or jointly for design registration.
- Definition of Person: The term “person” encompasses a variety of entities, including firms, partnerships, small entities, and corporate bodies.
The design must be novel and not have been published or used in India before the filing date. The official fees for filing an industrial design registration application are ₹ 1,000 for small entities and ₹ 4,000 for large entities.
